Issues to Address in a High Conflict Divorce
Divorce-related disputes can often be very emotional, and a person who is angry or sad about the end of their marriage may find it difficult to consider their spouse's wants and needs when attempting to resolve the issues in a divorce case, especially if the marriage broke down due to issues such as infidelity or alcoholism. When a case involves these types of emotional disputes, spouses may find it hard to compromise and reach agreements.

Some issues that can lead to contentious disputes between divorcing spouses include:
Asset and debt division - Spouses will often disagree about who should receive different pieces of property, especially if certain items are important to both of them. A person may believe that the other party should receive a smaller share of the marital estate because they earned the majority of the family's income or because they blame their former partner for the breakdown of their marriage. However, Colorado law requires assets and debts to be divided fairly and equitably, without considering marital misconduct. Disputes related to property may be resolved by fully understanding the value of both marital assets and separate property and considering the ongoing needs of both parties.
Child custody - Both parents may believe that they should be the primary parent for the children (or have primary custody), or they may disagree about who will have the right to make decisions about how children will be raised or when children will stay with each parent. Decisions about child custody should be based on what is in children's best interests. If parents are unable or unwilling to agree on these matters, a child custody evaluator (CFI) or parental rights evaluator (PRE) may be appointed by the court to investigate the situation and offer recommendations on how to resolve child custody disputes in a way that protects the children's best interests.
Spousal support - A person who has relied on the income earned by their spouse during their marriage may ask for financial support to be paid following their divorce. This can often lead to disputes, since the wage-earner may not be willing or expecting to make ongoing payments, or they may believe that their spouse does not deserve to receive support since they were to blame for the divorce. However, decisions about spousal maintenance will be based on the parties' financial circumstances and needs, without considering marital misconduct.
